References to “we”, “us” and/or “our” in this Privacy Policy is a reference to AdviceMarket Pty Ltd (ACN 168 550 016) (Advice Market).

References to “you”, “your” and/or “user” means any person using or browsing the Site including but not limited to Adviser(s) and Consumer(s)

“Adviser(s)/Advisor(s)” is a person, company and/or other entity listed on the Site for the purpose of being connected with a Consumer seeking advice.

“Consumer(s)” is a person, company and/or other entity who visits the Site for the purpose of being connected with Advisers.

“Personal information” is information we hold which is identifiable as being about you.

“Pitch” means the right for an Advisor to respond to a request for advice by a Consumer.

“brief” means a request posted on the Site by a Consumer seeking an expression of interest from Advisers.

“Site” means www.advicemarket.com.

“Social Media” means social media forums, applications, functions and promotions (including but not limited to Facebook, LinkedIn, Google+, YouTube and Twitter).

1. WHAT PERSONAL INFORMATION WE COLLECT

1.1 We may collect the following types of personal information from you:

a) name;
b) address;
c) phone number;
d) mobile phone number;
e) fax number;
f) email address;
g) credit card or debit card information (for Adviser(s));
h) information as to your professional memberships (for Adviser(s));
i) information obtained from an brief; information obtained from a Pitch;;
j) communications between you and us;
k) communications between you and an Adviser;
l) communications between you and a Consumer;
m) information about personal interests, hobbies, associations/affiliations, likes, dislikes, cultural background, languages spoken; (for Adviser(s));
(n) information about your personal circumstances including (but limited to) your financial position, marital status, date of birth, family tree; (for Consumers)
(o) any videos, photos or other media posted by you on the Site; (for Adviser(s))
(p) information you voluntarily provide us with via Social Media, SMS and email; and
(q) statistical information for the purposes of product development, risk assessment and audit requirements

2. HOW WE MAY COLLECT YOUR PERSONAL INFORMATION

2.1 We collect personal information from you in a variety of ways, including:

(a) when you interact with us electronically, in person or on the phone;
(b) when you interact with an Adviser and/or a Consumer on our Site;
(c) when you access the Site;
(d) when you add any information to your profile on our Site;
(e) when you post an brief (for Consumers);
(f) when you make a Pitch (for Adviser(s));
(g) when you post any comments on the Site;
(h) when you post any blogs on the Site;
(i) when you have any discussions through the ‘live chat’ function on the Site;
(j) when you click on any links contained in emails that we send you;
(k) when you provide us with information as part of the adviser verification process (for Advisers ;
(l) when you provide us with information through Social Media and widgets like the Social Media share buttons.

3. USE OF YOUR PERSONAL INFORMATION

3.1 We use your information to provide our service to you.

3.2 If you are an Adviser , we may disclose your personal information in circumstances which include, but are not limited to, the following:

(a) disclosure of your personal information to a Consumer who has posted an brief
(b) disclosure of your personal information to a Consumer who has accepted your Pitch;
(c) disclosure of your personal information to third parties for the purpose confirming your identity and/or ensuring you have the qualification which you say you have; and
(d) to improve our service and notify you of any opportunities that we think you might be interested in.

3.3 If you are a Consumer, we may disclose your personal information in circumstances which include, but are not limited to, the following:

(a) disclosure of your personal information to an Adviser who has responded to your brief
(b) disclosure of your personal information to an Adviser whose Pitch you have approved/selected;
(c) disclosure of your personal information to an Adviser to whom your brief has been referred; and
(d) to improve our service and notify you of any opportunities that we think you might be interested in.

3.4 We do not provide your information to third parties, except that we may provide your information to assist us in the provision of our services to you and/or in order to verify Advisers in accordance with clause 6 of the Terms of Use.

3.5 We may also use your personal information to:

(a) process any actions you have made through the Site;
(b) manage our ongoing relationship;
(c) resolve complaints;
(d) develop products and services we think may be of interest to you;
(e) conduct quality assurance and market research activities;
(f) provide you with weekly updates as to your activity on the Site;
(g) perform any of our other functions and activities relating to our business; and
(h) comply with laws and regulations.

4. DIRECT MARKETING

4.1 We may contact you to provide you with information about products and services offered by us and our related corporate and business partners that we think may be of interest to you.

4.2 Unless you have otherwise advised us, you consent to the use of any of your personal information which we have received from you whilst using the Site. If you do not want us to use your personal information for direct marketing, you can contact us at info@advicemarket.com and request that you be removed from any direct marketing list.

4.3 In the event that you do withdraw your consent to receive direct marketing we will still contact you to manage our ongoing relationship.

9.1 Please be aware that we may change this Privacy Policy in the future. The revised versions will be uploaded onto our website, so please review this Privacy Policy from time to time so that you keep yourself aware of any changes.

10. THE SITE

10.1 When you visit our website: When you come on to our website we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.
